Terms of Service

1. Acceptance of Terms

By accessing or using Realm VTT, you agree to be bound by these Terms and our Privacy Policy. If you are accessing the Service on behalf of an organization or entity, you represent that you have the authority to bind that organization to these Terms.

2. User Accounts

To use Realm VTT, you must create an account. When creating an account, you must provide a valid username. Your email address is required for login purposes but will not be shared with other users. You may also enter a Display Name, which will be visible to others within the platform.

Subscription Information:

To access certain premium features, users must provide payment information through a third-party processor (Stripe).

Account Security:

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized activity on your account.

3. Use of the Service

Realm VTT allows users to create custom campaigns using pre-built or self-created rulesets, dice rolls, character sheets, NPCs, and game assets. You can share your campaigns with others via invite codes. You may also export your modules for personal use or sell them on the platform (if you meet the necessary requirements).

4. Paid Games and Game Master Responsibilities

Realm VTT supports a paid games system where Game Masters (GMs) can charge players on a per-session basis. By offering paid games, GMs agree to the following terms and responsibilities:

Game Master Requirements:

• GMs must comply with all Terms of Service and community guidelines
• GMs may only use content they own or have proper licensing rights to use
• GMs cannot use copyrighted intellectual property without explicit permission from the rights holder (e.g., official D&D adventures, copyrighted characters, etc.) on their game listings
• Game listings and promotional materials must not contain adult imagery, explicit sexual content, or other inappropriate material
• GMs must provide honest and accurate descriptions of their games
• GMs are responsible for delivering the gaming experience as advertised

Platform Fees and Payments:

• Realm VTT retains 10% of all payments made to Game Masters (or 7.5% to Game Masters with subscriptions)
• Payments are processed through secure third-party payment processors
• GMs are responsible for any applicable taxes on their earnings
• Refund policies for individual games are set by the Game Master, subject to platform guidelines, but the platform retains the right to refund the full amount if the Game Master does not deliver a session as advertised

Prohibited Content for Game Listings:

• Adult or sexually explicit imagery in game thumbnails, descriptions, or promotional materials
• Copyrighted content without proper authorization
• Misleading or false advertising about game content or experience
• Discriminatory, hateful, or harassment-promoting content

Violation of these paid game terms may result in immediate removal from the paid games program, account suspension, or termination. Realm VTT reserves the right to investigate complaints and take appropriate action to maintain a safe and legal gaming environment.

5. Subscription and Payment

Realm VTT offers the following subscription tiers:

• Free Tier:

  Includes up to 200 MB of storage and access to all features.

• Standard Tier:

  Provides up to 5 GB of storage for $5.99/month or $49.99/year.

• Pro Tier:

  Provides up to 50 GB of storage for $9.99/month or $99.99/year.

Payments are processed via Stripe. All subscriptions are automatically renewed unless canceled. You may cancel your subscription at any time, but no refunds are provided for any remaining term. Stripe may apply taxes to applicable charges based on your billing address.

6. Ownership of Content and Intellectual Property

You own all original content that you create or upload to Realm VTT, including campaigns, characters, NPCs, and game assets. However, you may not publish or sell content on the Marketplace unless you hold the necessary rights or licenses.

Intellectual Property Restrictions:

• You may not publish or sell copyrighted material owned by others without explicit permission
• This includes but is not limited to: official game modules, copyrighted characters, trademarked names, copyrighted artwork, and licensed music
• Fan-created content based on copyrighted properties is not permitted in paid games or marketplace listings
• Users are fully responsible for ensuring they have rights to all content they upload to their campaigns

Realm VTT may remove content published to the marketplace that violates intellectual property rights without notice.

Marketplace Purchases and Content Redistribution:

• Content purchased from the Realm VTT Marketplace is licensed for use exclusively within the Realm VTT platform
• You may not export, download, extract, or otherwise remove purchased marketplace content from the platform for the purpose of redistribution, resale, or use outside of Realm VTT
• Sharing, distributing, or making available purchased marketplace content to third parties through any means (including but not limited to file sharing, social media, or other platforms) is strictly prohibited
• Circumventing technical measures designed to protect marketplace content is a violation of these Terms and may constitute copyright infringement under applicable law
• Violation of these restrictions may result in account suspension or termination and may expose you to legal liability for copyright infringement

These restrictions exist to protect the intellectual property rights of content creators who sell their work on our Marketplace. By purchasing content, you agree to respect these rights and use the content only as intended within Realm VTT.

7. Account Suspension and Termination

Realm VTT reserves the right to suspend or terminate your account for the following reasons:

• Violating copyright laws or infringing on the intellectual property of others
• Engaging in malicious activities, such as attempting to hack the software or gain unauthorized access to other accounts
• Sharing account credentials or distributing content that violates intellectual property laws
• Violating paid games terms, including use of unauthorized content or inappropriate material in game listings
• Posting adult imagery or explicit content in game listings or promotional materials
• Fraudulent activity related to payments or refunds

When an account is suspended, the user will be unable to log in. Data will only be deleted if it violates copyright laws. Account termination may occur for severe violations without prior notice.

8. Governing Law

These Terms will be governed by and construed in accordance with the laws of the United States and Delaware. Any disputes will be resolved in the courts located in Delaware.

9. Disclaimer and Limitation of Liability

The Service is provided "as is" and Realm VTT makes no representations or warranties regarding the availability, reliability, or functionality of the platform. We are not liable for any damages arising from your use of the Service, including but not limited to data loss, service downtime, or content errors.

10. Indemnification

You agree to indemnify and hold harmless Realm VTT, its affiliates, employees, and agents from any claims, damages, or liabilities arising from your use of the Service, including but not limited to violations of these Terms or intellectual property rights.
